1. Introduction

Welcome to Tempcraft! These Terms of Service ("Terms") govern your use of our SaaS platform, which provides a drag-and-drop email creation interface and secure REST API endpoints for transactional and marketing emails (the "Service"). By creating an account or using our Service, you agree to be bound by these Terms.

2. Description of Service

Our Service allows customers to design emails using a web-based drag-and-drop interface and send campaigns. It also provides REST API endpoints for integrating email sending capabilities into their own systems via API keys. We offer various monthly subscription - tiers based on email volume and access to advanced features.

3. User Accounts

To use the Service, you must register for an account and provide accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials (including your API keys) and for all activities that occur under your account. You agree to notify us immediately at support@tempcraft.co of any unauthorized use of your account.

4. Subscriptions and Payment

The Service is billed on a subscription basis. You will be billed in advance on a recurring, periodic basis (such as monthly). Your subscription will automatically renew at the end of each billing cycle unless you cancel it through your account dashboard. All payments are processed through our third-party payment processor, Paddle. We do not store your credit card details.

5. Refund Policy

Due to the nature of our digital service, we do not offer refunds for subscription fees. You may cancel your subscription at any time, and you will continue to have access to the Service through the end of your current billing period. No partial refunds will be issued.

6. Acceptable Use and Email Sending Policy

Your use of the Service is conditional upon your adherence to this Acceptable Use Policy. Violation of this policy may result in immediate account suspension or termination without refund.

a. Recipient Consent: You must only send emails to recipients who have given you explicit, verifiable permission to contact them (i.e., "opt-in"). The use of purchased, rented, third-party, or scraped email lists is strictly prohibited. You are solely responsible for maintaining proof of consent for all your contacts.

b. Prohibition of Spam: You shall not use the Service to send unsolicited commercial email ("spam") or any other form of prohibited content. Prohibited content includes, but is not limited to, material that is illegal, fraudulent, harassing, or promotes hate speech, violence, or discrimination.

c. Mandatory Unsubscribe Mechanism: Every marketing or bulk email sent through the Service must include a clearly visible, single-click unsubscribe link. This mechanism must be functional and immediately honor the recipient's request to be removed from your mailing list.

d. Sender Reputation Monitoring: To protect the integrity and deliverability of our platform for all users, we actively monitor sender reputation metrics for every account. These metrics include bounce rates, complaint rates, and other deliverability signals.

e. Automated Account Suspension: Our system will automatically suspend the email sending capabilities of any account that exceeds the following industry-standard thresholds:

  • A bounce rate consistently higher than 5%.
  • A complaint rate consistently higher than 0.1%.

This is a protective measure to prevent damage to your sender reputation and our shared IP infrastructure. You will be notified if your account is suspended, and you will be required to provide a plan of action to resolve the underlying issue before sending can be resumed.

f. Right to Investigate and Terminate: We reserve the right to investigate any account suspected of violating this policy. We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, for any breach of these Terms, particularly for severe violations such as sending to prohibited lists or engaging in illegal activities.

7. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Tempcraft, nor its directors, employees, partners, agents, or suppliers, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; and (iii) any content obtained from the Service.

8. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect by posting a notice on our website or by sending an email to the address associated with your account. What constitutes a material change will be determined at our sole discretion.
